Alternative and Complimentary Holistic Health Care Practitioner in Colorado
The Mindful Bird is a small alternative and complimentary holistic health care business based on overall health and well-being. Erin of The Mindful Bird is not a medical doctor or psychologist and cannot assess, diagnose, treat, prescribe, or counsel physical and mental medical disease or illness. As a Reiki Master Practitioner and Energy Intuitive with a background in Human Ecology and Health Sciences, Erin can hold space for you to bring recognition to the areas in your life where you need healing. Erin can make suggestions but does not provide professional, medical, or therapeutic advice to increase your mindfulness and your own healing practice. Any medical conditions brought up in a healing session should be discussed with your board certified doctor or licensed therapist. Erin has the right to refer you out to any board certified or licensed therapist in the state of Colorado if Erin deems appropriate that work is moving outside of her scope of practice. Erin nor The Mindful Bird are licensed or certified by the State of Colorado and cannot perform anything outside of her scope of practice as an Alternative and Complimentary Health Care Practitioner.
According to the Senate Bill 13-215 (3)(B I,II) an Alternative and Complimentary Health Care Practitioner (“practitioner”) means a person who provides complimentary and alternative health care services in accordance with this section and who is not licensed, certified, or registered by the state as a health care professional. Where as “complimentary and alternative health care services” include: Healing practices using food, food extracts, dietary supplements as defined in the Federal Dietary Supplement Health and Education act of 1994”; Nutrients; Homeopathic remedies; the physical force with heat, cold, water, touch, sound, and light; stress reduction healing practices and mind-body and energetic healing practices. Erin is not a LMT but is permitted the practice of the use of touch, words, directed movement of a healing art, touch, mind-body centering, reflexology, reiki and practices with the primary purpose of affecting energy systems of the body (6)(q)(B).
Though Erin is Licensed by the State of Colorado as a Certified Nurses Assistant, she is strictly licensed to perform these duties under the supervision of a Licensed Registered Nurse in a medical setting in the state of Colorado. Erin carries this license but does not perform duties of this license under her role as an Alternative and Complimentary Health Care Practitioner. Erin is not prohibited to practice as a CNA in a medical setting while also maintaining an Alternative and Complimentary Health Care practice. Erin cannot perform Alternative and Complimentary Health Care practice duties under paid hours as a CNA and cannot perform CNA duties within the Alternative and Complimentary Health Care practice. Both certifications are practiced separately unless otherwise stated, permitted, or exempt by the Department of Regulation Agencies of Colorado.
As per Title 12- section 10 (c), This does not inhibit Erin to advise, educate or counsel about the structure and function of the human body and the use of natural health care products to support health and wellness. Erin holds an accredited Bachelor’s of Science from Rutger’s University in Human Ecology and an Associate’s of Science from Community College of Denver in Human Health Sciences (10) (A) (B) (C). Erin’s education background does not qualify Erin to asses, treat, prevent, diagnose, medical or mental illness.
In Colorado Revised Statutes Title 12. Professions and Occupations § 12-36-106. Practice of medicine defined--exemptions from licensing requirements include:
(l) The rendering of services, other than the prescribing of drugs, by persons qualified by experience, education, or training, under the personal and responsible direction and supervision of a person licensed under the laws of this state to practice medicine, but nothing in this exemption shall be deemed to extend or limit the scope of any license, and this exemption shall not apply to persons otherwise qualified to practice medicine but not licensed to so practice in this state;
(m) The practice by persons licensed or registered under any law of this state to practice a limited field of the healing arts not specifically designated in this section, under the conditions and limitations defined by such law;
(z) Rendering complementary and alternative health care services consistent with 6-1-724, C.R.S
As for the reader of the document “potential client” or “client”, failure to seek additional or suggested medical advice from a Board Certified Physician or Licensed Psychologist, Psychiatrist, Counselor, or Social Worker, is the not the responsibility of the Erin or the Alternative and Complimentary Health Care Practitioner. It is the full responsibility of the client or potential client to seek additional medical advice to support the holistic picture and medical well-being. The Mindful Bird nor the practitioner guarantee any medical results from this practice. Any increase in medical or mental illness is not the responsibility of the practitioner but the failure of the client to seek additional medical attention and at this time the client will have been referred out to a state licensed or certified medical professional.

Any The Mindful Bird carries Professional Liability Insurance through NACAMS.

Cancellation Policy
In scheduling, confirmation, arrival upon your appointment, and through confirmation of this document at check out, you, hereby, agree to The Mindful Bird's cancellation policy.
General Cancellations
If you cancel within 24 hours of your appointment, the card on file will be charge 50% of your appointment fee.
No-Show
If you choose to not show at the time of the appointment with no contact to Erin within 15 minutes of the appointment start time, the card on file will be charged 100% of the appointment if and when conditions apply (any non-emergent situation). Erin will contact the client 15 minutes after the appointment start time to consider emergent situations*.
Practitioners
Practitioners of The Mindful Bird reserve the right to cancel or reschedule an appointment at any time. Energy and suggestive mindfulness practices should not be transferred unless the provider's mind is clear and their health and wellness is clear to care for another. Practitioners will abide by the golden rule to provide cancellation information before the 24 hour mark of start of the client's appointment.
*Emergent situations
Emergent situations are to be respected between both the practitioner and the client. In case of an emergency, please contact an emergency medical team (9-1-1).
Communication between practitioner and client should be reported as soon as one has the time to inform the other of said cancellation and situation. Special conditions will be considered to waive the cancellation fee such as a motor operations accident, a missing persons, death, fire, natural disaster, or other extreme scenarios.
In the case of a No Show appointment and suspected emergent situations, The Mindful Bird will wait 24 hours from the time of the scheduled appointment to hear from the client. After 24 hours from the appointment start time, if the client does not contact The Mindful Bird the card on file will be charged the full amount. If within 24 hours the client contacts The Mindful Bird with explanation of emergency situation, The Mindful Bird will consider said circumstances and rescheduling without a rescheduling fee.
